These Terms of Service govern your use of the Visit Bewdley website at visitbewdley.uk (the “Website”). By using the Website, you agree to comply with these Terms.
1. About Visit Bewdley
Visit Bewdley is an independent destination website operated by Paul James trading as Paul James Digital.
Visit Bewdley is independently owned and operated. It is not operated by, affiliated with, endorsed by or an official website of Bewdley Town Council, Wyre Forest District Council, Worcestershire County Council, Visit Worcestershire or any other local authority, tourism authority or public body.
References in these Terms to “Visit Bewdley”, “I”, “me” or “my” mean Paul James trading as Paul James Digital, as operator of the Website.
2. Purpose of the Website
Visit Bewdley provides information about Bewdley and the surrounding area. This may include business and organisation listings, attractions, places to visit, events, news, articles, local information and other content that may be useful to residents and visitors.
The Website is an independent information and destination resource. Unless expressly stated otherwise, inclusion of a business, organisation, event, attraction, product or service on the Website does not amount to an endorsement, recommendation, guarantee or approval by Visit Bewdley.
3. Using the Website
You may use the Website for lawful personal, informational and business purposes.
You must not use the Website:
- for any unlawful or fraudulent purpose;
- in a way that may damage, disable, overload, impair or interfere with the Website or its operation;
- to attempt to gain unauthorised access to the Website, its server, systems, accounts or data;
- to knowingly introduce viruses, malicious code or other harmful technology;
- to collect or harvest personal information from the Website unlawfully;
- to impersonate Visit Bewdley, Paul James Digital or any person, business or organisation appearing on the Website; or
- to reproduce, scrape, systematically extract or commercially exploit substantial parts of the Website or its content except where permitted by law or with my prior permission.
I may restrict or block access to the Website where I reasonably consider this necessary to protect the Website, its users, its content, my business or my legitimate interests.
4. Listings and Local Information
Business listings, organisation listings, attraction information and other local content may be created from information supplied directly to Visit Bewdley, information made publicly available by the relevant business, organisation or operator, information submitted by members of the community, or other sources that I reasonably consider appropriate.
I may rewrite, summarise, reorganise or otherwise edit factual information when preparing content for the Website.
I take reasonable care when publishing information, but businesses, venues, services and circumstances can change. I therefore cannot guarantee that every listing or item of information will always be accurate, complete or up to date.
If you identify information that appears to be incorrect or out of date, please contact me at [email protected].
5. Events and Time-Sensitive Information
Event details, opening hours, prices, availability, dates, times, locations and other time-sensitive information published on Visit Bewdley may be supplied by third parties or obtained from information made publicly available by the relevant organiser, venue, business or organisation.
I take reasonable care when publishing this information, but events may be changed, postponed or cancelled and business information may change without notice. I cannot guarantee that all such information will remain accurate or up to date.
Before travelling, attending an event, making a booking, purchasing tickets or incurring significant expense, you should confirm important details directly with the relevant organiser, venue or business.
Visit Bewdley is not the organiser, ticket seller, venue operator or promoter of an event merely because that event appears on the Website, unless the Website expressly states otherwise.
6. Editorial Control
Visit Bewdley is an independently owned and edited website. I retain full editorial discretion over what is and is not included on the Website.
There is no entitlement to have a business, organisation, event, attraction or other content listed, featured or promoted on Visit Bewdley.
I may accept, refuse, edit, categorise, correct, update, suspend or remove any listing, event, submission or other content at my discretion.
This discretion may be exercised for editorial, operational, reputational, community, commercial or other reasons that I consider relevant to the Website. I am not required to publish a listing simply because another comparable business, organisation or event is included.
I may make reasonable editorial changes for matters including spelling, grammar, formatting, presentation, consistency, categorisation, accessibility and clarity without seeking further approval.
Unless I choose otherwise, decisions concerning whether content is accepted, refused, restricted or removed are final and I am not obliged to provide reasons or operate an appeals process.
7. Submissions
If you submit a business listing, event, photograph, logo, description, correction, article, news item or other material to Visit Bewdley, your submission is also subject to the Visit Bewdley Submission Guidelines in force at the time of submission.
You must only submit material that you are entitled to provide and that Visit Bewdley is entitled to receive and use in accordance with those Submission Guidelines.
Submitting material does not guarantee that it will be published or, if published, that it will remain on the Website indefinitely.
I may contact a person who has submitted information where clarification, verification or additional information is reasonably required.
8. Relationship with Listed Businesses and Organisations
Unless expressly stated otherwise, a business, organisation, attraction, venue or event appearing on Visit Bewdley is an independent third party.
The inclusion of an ordinary listing does not, by itself, create a contractual, commercial, agency, partnership, employment or representative relationship between Visit Bewdley and the person, business or organisation listed.
I do not act as agent for a listed business, organisation, venue or event organiser unless this is expressly stated.
Any enquiry, booking, purchase, contract or other arrangement that you make directly with a third party is between you and that third party. Their own prices, terms, cancellation arrangements, privacy practices and other conditions may apply.
Visit Bewdley is not responsible for the acts, omissions, products, services, availability or performance of an independent third party merely because that third party is mentioned or listed on the Website.
9. Advertising, Featured Listings and Commercial Content
Visit Bewdley may offer or display paid advertising, sponsorship, featured listings, enhanced listings or other promotional content from time to time.
Where content has been given greater prominence as part of a paid advertising, sponsorship or promotional arrangement, I may identify it using wording such as “Featured”, “Sponsored”, “Advertisement” or another appropriate description.
Payment for advertising, sponsorship, a featured listing or another promotional service does not give an advertiser or listed business editorial control over the Website generally.
I retain the right to refuse advertising or promotional material that I do not consider suitable for Visit Bewdley.
Separate terms, pricing, duration, payment arrangements or other conditions may apply to paid advertising, sponsorship, featured listings and other commercial services.
Unless expressly agreed otherwise as part of a separate commercial arrangement, the appearance of an advertisement or promotional placement does not amount to an endorsement or recommendation by Visit Bewdley.
10. External Links
The Website may contain links to websites, booking systems, ticketing services, social media pages or other online services operated by third parties.
These links are provided for convenience and information. I do not control third-party websites and am not responsible for their content, availability, security, accuracy or privacy practices.
A link from Visit Bewdley to another website does not necessarily mean that I endorse that website, business or service.
You should review the terms, privacy information and other conditions applicable to any third-party service that you choose to use.
11. Intellectual Property
Unless otherwise stated, original text, articles, photographs, graphics, design elements, branding, layout and other original content created by or specifically for Visit Bewdley are owned by or licensed to me and may be protected by copyright, trade mark rights and other intellectual property rights.
Facts and information about businesses, organisations, places and events may be obtained from publicly available sources and rewritten, summarised or independently presented for the purposes of Visit Bewdley.
Logos, photographs, promotional materials and other content belonging to businesses, event organisers, photographers, contributors or other third parties remain the property of their respective rights holders where applicable.
The appearance of third-party material on the Website does not transfer ownership of that material to Visit Bewdley.
You may view and use the Website for your own lawful purposes, but you must not copy, republish, reproduce, distribute or commercially exploit protected Website content without the permission of the relevant rights holder, except where permitted by law.
Nothing in these Terms transfers ownership of any intellectual property rights to you.
12. Logos and Promotional Material
Visit Bewdley may display a business or organisation’s name, logo or other identifying material in connection with a relevant listing or article.
Where promotional material has been submitted directly to Visit Bewdley, or has been made available for the purpose of publicising a business, organisation or event, I may use that material where I reasonably understand that its use for that promotional purpose is permitted.
If you own or control rights in a logo, photograph or other material appearing on Visit Bewdley and you do not want it displayed, please contact me at [email protected]. I will consider the request and, where appropriate, remove or replace the material.
13. Copyright and Other Rights Concerns
I aim to respect the copyright, trade mark rights and other legal rights of third parties.
If you believe that content published on Visit Bewdley infringes your copyright or other rights, please email [email protected].
Please provide enough information for me to identify the material concerned, understand the basis of your claim and contact you about it.
I may temporarily remove, replace or restrict access to disputed material while I consider a complaint where I believe this is appropriate.
14. Availability of the Website
I aim to keep Visit Bewdley available and functioning properly, but I do not guarantee that the Website or any particular part of it will always be available, uninterrupted or free from technical problems.
I may maintain, update, change, suspend or withdraw all or part of the Website where reasonably necessary.
I am not obliged to continue operating any particular feature, listing category, directory, event service or other part of the Website indefinitely.
15. Responsibility and Liability
I take reasonable care in operating Visit Bewdley, but the Website is primarily an informational resource and some information is supplied by or relates to independent third parties.
To the extent permitted by law, I am not responsible for losses arising solely from reliance on inaccurate, incomplete or outdated information supplied by third parties, or from the acts or omissions of independent businesses, venues, event organisers or other third parties referred to on the Website.
You are responsible for checking information that is important to a decision to travel, attend an event, make a booking, purchase goods or services or incur significant expense.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, or liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded.
Nothing in these Terms affects any rights that you may have under applicable law which cannot lawfully be excluded or restricted.
16. Privacy
Personal information collected through the Website is handled in accordance with the Visit Bewdley Privacy Policy, which is published separately on the Website.
17. Changes to the Website and These Terms
I may update these Terms from time to time, including where necessary to reflect changes to the Website, its services, my business activities or applicable legal requirements.
The current version of these Terms will be published on this page together with the date on which it was last updated.
Changes will apply from the date the updated Terms are published unless otherwise stated.
